Terms of service
Draft, not yet reviewed by a lawyer. This text is a working draft and may change before Aria takes payments. Placeholders in [square brackets] are still to be filled in.
These terms are an agreement between you and [Company legal name], [registered address], company number [number] (“Aria”, “we”). They apply when you create an Aria account or use Aria’s website, Mac app, command-line tool, API or servers (together, “the service”). By ticking the box at sign-up you accept them, and the privacy policy.
1. The service
Aria sets up and runs your applications, databases and related services on servers that Aria rents for you (“managed servers”) or on servers you connect yourself. You describe what to run in an aria.yaml file; Aria provisions the server, deploys your code and keeps it running. Features that aren’t available yet are labelled “Planned” on the website and in the app.
2. Your account
- You must be at least 18 and able to enter into a contract. If you use Aria for an organisation, you accept these terms on its behalf.
- Give a real email address you control; we use it for codes, security notices and billing.
- Keep your password and recovery codes safe. Turn on two-factor authentication. You’re responsible for what happens under your account, including what agents and API keys you authorise do.
- Tell us at [security contact] if you think your account was used without your permission.
3. Acceptable use
You must not use Aria, or let anyone use your servers, to:
- break the law, or host content that is illegal where you or your users are;
- send spam or unsolicited bulk email (outbound mail on port 25 is blocked on managed servers unless we enable it for you);
- attack, scan or disrupt other systems, or run botnets, phishing, malware or open proxies;
- mine cryptocurrency, or place a load on shared infrastructure out of proportion to your plan;
- get around limits, sign up repeatedly to obtain resources, or resell the service without our written agreement;
- infringe anyone’s intellectual property or privacy.
If a server is used in breach of this section, or our infrastructure provider reports abuse, we may suspend the affected workspace straight away to stop the harm, and we will tell you why. Data is kept while a workspace is suspended.
4. Your content and data
Your code, configuration, databases and files stay yours. You give us the rights we need to host, copy, back up and process them only to run the service for you. For personal data in your applications, you are the controller and we are your processor under the data processing agreement, which forms part of these terms. You are responsible for having a lawful basis for that data, including special categories such as health data.
5. Plans, payment and non-payment
- Managed servers are paid monthly, in advance, at the price shown when you choose a plan. Prices include or add VAT as shown at checkout. Payments are processed by Stripe; we never see your full card number.
- A plan renews every month until you cancel it. Cancelling stops the next renewal; the server stays until the end of the period you paid for.
- If a payment fails, we retry and email you. After a grace period of [7] days unpaid, the workspace is suspended: services stop, data is kept. If the plan is still unpaid or ended [30] days after that, the workspace and its data are deleted. We warn you by email before deletion.
- [Refund policy: to be decided by the founder.]
6. Backups and availability
Aria takes backups as described in the app for each database or volume, but you remain responsible for keeping your own copies of anything you can’t afford to lose. We work to keep the service available, but at this stage we don’t offer a service-level agreement; maintenance and outages can happen.
7. AI features and agents
Aria can work with coding agents (through keys you create) and offers an AI operator. Agents and the AI operator can only request changes that you allow; destructive actions and secret values need your approval in the app. AI output can be wrong: check it before you rely on it.
8. Suspension and ending the agreement
You can delete your account at any time from Security and privacy on the website, once your workspaces are deleted. We may suspend or end your access if you seriously or repeatedly break these terms, if you don’t pay, or if the law requires it. Where we can, we give notice and time to export your data first.
9. Liability
[Limitation of liability, warranties disclaimer and indemnity: to be written with the founder’s lawyer. Nothing in these terms limits liability that can’t be limited by law, such as for fraud, or for death or personal injury caused by negligence, or a consumer’s statutory rights.]
10. Changes to these terms
We may update these terms. For changes that matter, we tell you by email and ask you to accept the new version when you next use Aria; the version you accepted and when is recorded on your account.
11. Law and contact
These terms are governed by the law of [jurisdiction], and the courts of [jurisdiction] have jurisdiction, without taking away any rights you have as a consumer where you live. Questions: [contact email].
